TMLP Protests Judicial Appointments, Citing Violation of Social Justice and Inclusion

The Terai-Madhesh Loktantrik Party (TMLP) has protested the recent appointments of High Court judges by the Judicial Council, stating that the decision goes against the constitutional guarantees of social justice and inclusion.
In a statement released today by TMLP Chairman Brisesh Chandra Lal, the party expressed shock and disappointment over the Judicial Council’s decision made on 22 Shrawan 2082 regarding the recommendation and appointment of judges for the High Courts. The statement claims that the decision constitutes a direct violation of Article 18 of the Constitution, which guarantees the right to equality, and Article 42, which ensures the right to participate in state bodies based on principles of social justice and inclusion.
The statement further reads: “It is surprising and disheartening that such a decision has come from the Judicial Council, chaired by the Chief Justice — who is also responsible for interpreting constitutional provisions — within the Supreme Court and the Constitutional Bench. This decision adversely impacts the accepted principle of ensuring equal justice for all and maintaining inclusive arrangements in the dispensation of justice.”
The TMLP has urged all concerned persons to reconsider the decision and create a standard framework that guarantees the right to inclusion as enshrined in the Constitution.
