Foreign Mediation to be Enforceable in Nepal Under Proposed Law
Kathmandu. A law is being drafted to allow mediations conducted abroad to be enforceable in Nepal as well. The Ministry of Law, Justice and Parliamentary Affairs is amending the Mediation Act, (2068 B.S) to ensure that foreign mediation settlements can be implemented within the country.
This provision is proposed in Section 31 of the amendment bill. According to this, if the bill becomes law, foreign mediation agreements will be recognized and enforced in Nepal, provided that Nepal is a party to a relevant treaty that provides for the recognition and enforcement of such documents.
